What this Privacy Policy Covers

Your privacy is important to us. Because we may gather certain types of personally identifiable information, including, but not limited to, name, contact information, date of birth, and gender (“Personal Information”), from users of the Website and services offered by this Website (individually each a “WOTH-FM Internet Service” and collectively “WOTH-FM Internet Services”), we feel you should know how we may collect, use, disclose, manage, and store the Personal Information that you provide us. Accordingly, this policy (the “Privacy Policy”) covers how WOTH-FM treats Personal Information that we collect via this Website or WOTH-FM Internet Services.

This Privacy Policy applies only to WOTH-FM’s online collection of Personal Information via this Website and WOTH-FM Internet Services. This Policy does not govern WOTH-FM’s offline collection of Personal Information (including in connection with the over-the-air broadcast operations of WOTH-FM) or any collection of personal information, online or offline, by WOTH-FM’s corporate parent(s), affiliates, or any other company, unless specifically stated.  Likewise, this policy does not govern WOTH-FM’s presence on third-party social networking sites or any mobile applications not offered for download on this Website.  This Privacy Policy does not apply to the practices of companies that are not owned or controlled by WOTH-FM.

Additionally, certain areas of the Website and WOTH-FM Internet Services, including, without limitation, certain contests, may be governed by additional terms (“Additional Terms”) presented in conjunction with those areas and services.  Additional Terms and the Privacy Policy apply equally, except that, in the event of an irreconcilable inconsistency, Additional Terms will control.

This Privacy Policy is incorporated by reference into the Website’s Terms of Use (the “Terms of Use”).

Protection and Privacy of Children

Neither this Website nor any WOTH-FM Internet Service is directed to children younger than 13 years old. We do not knowingly collect, use, store, or disclose the Personal Information of any person under the age of 13. When a user discloses Personal Information on the Website or with respect to any WOTH-FM Internet Service, he or she is representing his or her age as at least 13 years of age.  If you are the parent or legal guardian of a child under 13 who may have registered in the HOT Club (see below) or otherwise provided his or her Personal Information, please contact us as described below.

HOT Club

You can register for the HOT Club via the Website. To become a member of the HOT, you may be required to provide certain Personal Information, including, but not limited to, first and last name, email address, age, gender, and zip code.  We may request additional information about you, your interests and opinions.

WOTH-FM may retain whatever information you submit.  We may use your Personal Information for operational and business purposes, including, but not limited to, learning how we can improve our Station and Website, letting you know about offers from the Station and our partners that may be of interest to you, and developing new services and features. Additionally, we may share your Personal Information with our corporate parents and affiliates for business reasons.

Once you are registered in the HOT Club, you may receive emails or other communications from WOTH-FM concerning programming, upcoming events and contests, the Website, WOTH-FM Internet Services, offers from WOTH-FM or its partners, and similar Station- and Website-related information (“HOT Club Emails”).  You may also receive SMS text messages on your mobile phone containing similar information (“Frequent Rockers Club Texts”).  WOTH-FM itself charges no fee in connection with the HOT Club Emails or HOT Club Texts.  Your use of these services could result, however, in charges from your service provider(s). You are responsible for all such charges, and you agree that WOTH-FM is not responsible for any such charges. HOT Club members are sometimes automatically registered for online contests as well.  We reserve the right to terminate membership in the HOT Club at our sole discretion, with any reason or no reason, with or without notice to you.

HOT Club Emails will contain a link that you can use to remove yourself from the HOT Club.  When you remove yourself from the HOT Club, we will no longer send you HOT Club Emails or HOT Club Texts.  Please note, however, that removing yourself from the HOT Club does not necessarily result in the deletion of all your Personal Information from our records.

As part of the HOT Club registration process, you will obtain a username and password, which you can use to review and update some Personal Information you have provided us.  You will also be able to remove yourself from the HOT Club.   During the registration process, you may also be presented with an option to “opt in” to National and/or Regional content Emails based on your interests. These Emails originate from a third party partner and WOTH-FM is not responsible for the frequency or content of these Emails. All HOT Club Emails also will contain links that you can use, along with your username and password, to review and update some Personal Information you have provided us or to remove yourself from the HOT Club.

Because your username and password provide access to your Personal Information, you should not share them with others.  If you have any questions about your HOT Club membership, you may contact us using the information at the bottom of this Privacy Policy.

Online Contests

WOTH-FM may collect Personal Information from you in connection with various WOTH-FM contests (“Contests”).

In some cases, you may be required to register for the HOT Club in order to participate in the Contest.  Our treatment and use of Personal Information submitted in connection with Contests requiring registration in the HOT Club will be governed by this Privacy Policy.

Some Contests do not require registration in the HOT Club.  Our treatment and use of Personal Information submitted in connection with such Contests will be governed by our General Contest Rules, as modified by each contest’s specific rules (collectively, “Contest Rules”). Contest Rules will be clearly referenced in the portion of the Website used to collect Personal Information in connection with each Contest.  Contest Rules may contain Additional Terms which differ from the terms of this Privacy Policy.  Additional Terms and this Privacy Policy shall apply equally. In the event of an irreconcilable inconsistency between the Additional Terms and the Privacy Policy, the Additional Terms shall control.  Accordingly, you should review the Contest Rules and any Additional Terms before submitting your Personal Information to us in connection with a Contest.

You should be aware that different rules might apply to the collection, storage, use and disclosure of your information by third-parties in connection with their advertisements, promotions and other websites you encounter on the Internet. The activities of such third-parties are controlled by those third-parties, not by us, even if we have relationships with those third-parties and even if their advertisements appear on our Website. Accordingly, the collection, use, and disclosure of Personal Information by third-parties is governed by the privacy policies of those third-parties, not this Privacy Policy.  If you have questions or concerns about how third-parties collect, store, use and disclose Personal Information, we encourage you to investigate and ask questions directly of them.

Similarly, the Website and WOTH-FM Internet Services may include links and/or references to websites operated by, or services provided by, third-parties.
